The appellant had filed suit No. KTH/120/M/99, before the Katsina State High court in which he applied for the enforcement of his fundamental right to fair hearing and personal liberty against the respondents. He also claimed that the actions of the respondents had injured his professional credit and reputation.
According to the appellant, his suit was consolidated with suit No. KTH/121/M/1999 filed by one Kabir Yusuf Yar'adua against the respondents and heard together by the High Court. At the end of trial, the High Court delivered a single judgment in respect of the consolidated suits on 12/2/2002, dismissing them. Being dissatisfied with the decision dismissing his application and the delivery of single judgment, the appellant filed a notice of appeal against same dated the 25/2/2002, which was later amended with the leave of the court. The amended notice of appeal was dated and filed on the 14/11/2006 and contained eight (8) grounds of appeal.
